The U.S. Department of Justice dismissed its corruption case Wednesday against New Jersey Sen. Robert Menendez after prosecutors had announced their intention to retry him on corruption charges.

This development comes two months after Menendez’s trial ended in a mistrial. He had been indicted along with Dr. Salomon Melgen, in connection to allegations of conspiracy to commit bribery and honest services fraud, violating the Travel Act, bribery, and honest services mail and wire fraud. Menendez was additionally charged with making false statements to a government agency.

The longtime Democratic senator is running for re-election.

“Given the impact of the court’s Jan. 24 order on the charges and the evidence admissible in a retrial, the United States has determined that it will not retry the defendants on the remaining charges,” U.S. Department of Justice spokesperson Nicole Navas Oxman said via email.
